Refund and/or Security Deposit. Tenants / Renters should be aware that each property sets its own Refund and/or Security
Deposit policies. AR~MLS® recommends that tenants / renters ask for
and receive a written notice of the Refund and/or Security Deposit policy from
the advertiser, owner or rental broker. See AR~MLS® Refund Policy
below.
Trip Cancellation Insurance. For added protection, we recommend the
purchase of Trip Cancellation Insurance at your own expense. AR~MLS®
is not responsible for the refund of rental fees for any reason.
Property Owners - If
the operators of AR~MLS® are unable to provide the
promised level of service for any reason, AR~MLS® or its
owners can not be held liable for any costs beyond the prorated costs
paid by the client for the services which were not provided. AR~MLS®
does not guarantee that the AR~MLS® web site will be available
100% of the time. This Agreement shall be construed in accordance with the laws
of Colorado, any and all disputes shall be submitted
to the jurisdiction of Colorado,
disregarding conflicts of law, forum and venue.

Notice to Paid Advertisers, or "Link Access" subscribers
/ Membership Cancellation Policy.
AR~MLS® paid listings
run on an annual basis. Due to the fact that the vast majority of the work
involved in promoting vacation rental properties on the Internet occurs in the first few days (creating the data entry ad, adding photos, etc.) AR~MLS®
is only able to offer a partial refund once your first listing is
online. Sorry, but no refunds on second or subsequent listings. For complete
details, please see our refund policy.
Property
owners are responsible for investigating and adhering to all local regulations
including, but not limited to, permits, licenses, occupancy taxes, and safety
compliance.
Property off the market.
If
paid advertisers wish to remove property from the rental market, the rental broker could / would & should
temporarily inactivate the AR~MLS® listing and reactivate it at a
future date. Your AR~MLS® listing stays in force through the
original term and the renewal date does not change (the renewal date will not
be extended during the time that the property is off the market).
Sold Property
If
/ when a property is sold, a transfer can be arranged by AR~MLS®
to the new property owner. NOTE: No refund will be given,
however, existing and new rental broker members are encouraged to come to a fair division of
fees amongst themselves.
Selling A AR~MLS® Listing.
Warning
to potential purchasers and sellers of AR~MLS® rental listings (we're
talking about the sale of the rental listing, not the sale of the property - of course the owner can sell their property): AR~MLS® does NOT endorse
or approve of the sale or bartering of the AR~MLS® rental listing unless
the property being advertised is also sold to the same party. Any rental listing which
is advertised for sale or which we determine has been sold is subject to
immediate cancellation without notice and without refund. Please do not offer
to sell or purchase a AR~MLS® rental listing without transferring the property
at the same time.
Spamming Policy
Note:
AR~MLS® does not participate in, or tolerate the sending of Unsolicited
Commercial Email (SPAM) - AR~MLS® reserves the right to cancel
(without refund) any member that mentions AR~MLS® or any of
its associated websites, URL~MLS (Uniform Resource Locators), or any associated
AR~MLS® email address in any SPAM e-mail message or Usenet
posting. AR~MLS® is the sole judge in determining what
constitutes SPAM.
Rental Inquiries
Rental
inquires are delivered via Internet email and are not to be considered private.
Internet e-mail delivery is not 100% reliable and AR~MLS® cannot
be held responsible for undelivered inquiries or for missed income as a result
of undelivered inquiries. AR~MLS®, at its own
discretion, may supply to potential renters the direct e-mail address and or
phone number of AR~MLS® paid advertisers for information /
available date purposes.
Membership Policies
AR~MLS® reserves
the right to reject or edit any ad / data entry submitted at our sole discretion. Once
material has been submitted, edited and posted on the AR~MLS® web
site, it becomes the property of AR~MLS® and its affiliated sites
and may not be copied from the AR~MLS® web site without written
permission.
Local Rules / Regulations
Property
owners and/or their agents / brokers are responsible for investigating and

Protecting yourself while
renting.
AR~MLS® is supplying the following information to
help you determine if renting direct from a rental agent, or Broker is an option
you wish to pursue. By following a few simple suggestions, we believe that you
to can reap the benefits of renting while at the same time minimizing
your exposure to risk.
First, and foremost we must remind you that AR~MLS® operates
strictly as an advertising medium / Rental Referral Program - please fully read
our disclaimer above.
AR~MLS® lists resort properties in many various locations. By far the
vast majority of properties you will encounter on the Internet (especially
those listed on AR~MLS® services) are indeed legitimate. Nevertheless, we do recommend that you reduce your risk by using judgment and
caution. Remember that these suggestions apply when dealing with anyone you
don't personally know, whether a
business entity or an individual.
It
is very unusual that an owner or agent will reserve a property for you without
a deposit and typically they will expect full payment BEFORE YOU ARRIVE.
Remember that the owner or agent is turning over to you property that is
typically worth hundreds of times the rental rate. Since they normally only
have one or maybe a few properties to rent, when they reserve it for your use,
they will most likely have to turn away other renters who want to rent the same
time period. The rental Broker needs to insure that you do intend to occupy the
property during the time interval that you are reserving. This as well as
possible damage to the property is the reason a deposit is requested.
We
recommend that you satisfy yourself with the legitimacy of the ownership claims
prior to submitting your deposit.
1.
Ask the owners and/or their agents for referrals from previous renters.
2.
If the property is a part of a homeowners association, contact the association
to verify that the person you are corresponding with is indeed an owner and/or
the agent representing the owner.
3.
Ask for the name of the company who does the maintenance or cleaning and
contact them for verification. You might also wish to inquire regarding the condition
of the property.
4.
Ask for references from anyone else who services the property. For example,
pool service, snow removal etc..etc..etc
5.
Prior to sending any money to an owner and/or agent or providing a credit card
number, ALWAYS request and receive a completed rental agreement or contract. Be
sure that it specifies the dates you will be staying in the property, the cost
of the rental, any deposits, taxes, cleaning fees, and the cancellation /
refund policies. Without a signed rental agreement DO NOT consider the
rental to be yours. If you do and something unforeseen happens, you may have
little recourse in getting your funds returned. If an owner and/or agent prefers not to use a contract or
written agreement, find one that will.
6.
Your best protection can come by
working with property rental Brokers that accept credit cards, or wire transfers.
Firstly, there are certain protections that the banks put in place and not
everyone qualifies to accept credit cards.
Secondly, using your credit card does provide you with certain remedies that are
unavailable via other forms of payment. Note, paying via PayPal may not provide
you the same level of protection that paying directly via credit card
provides.
Thirdly,
view
photos of the rental property available.View photos of rentals available on
your mobile phone, or on the internet.
Refund Policies and Trip Cancellation / Interruption.
Resort properties are often booked many months in advance
and the property will be held for your use during your trip. When the property
is being held for you, it obviously cannot be rented to someone else.
Therefore, like cruise, tour packages and airline tickets, when
booking/reserving an Aspen rental property, you will
usually need to make a full or partial payment upfront in order to hold the
property.
Normally
this is not a problem, BUT if you have to cancel your trip (especially at the
last minute), you should know that you may forfeit a portion or all of your rental
fees. This is all according to the policy of the rental Broker you are dealing with.
There are ways to protect yourself however -
FIRST: Make sure you know what the cancellation policies are for
the property you are renting.
SECOND: Consider
purchasing Trip Cancellation Insurance for added protection.
If you have to cancel your resort
rental trip, are you eligible for a refund?
It depends on the cancellation/refund policy of the property that you are
renting and how much notice you are able to give. Usually the more notice that
you are able to give, the better chance that the property can be re-rented and
the more likely that you will be able to secure a partial or a complete
refund. Some properties may allow you to transfer your resort rental to
another time period. AR~MLS® recommends that you find out
about the cancellation/refund policy before you rent and ask for the policy in
writing when you reserve the property. For additional protection, we
recommend that you purchase Trip Cancellation Insurance. Most people are not
aware that this insurance is available for your vacation rental trip but it is
available thru companies that are on the internet.
What are some coverage reasons for Trip Cancellation / Interruption?
There are many different types of trip insurance available, but Trip
Cancellation and Interruption protection is the most important benefit you
should look for. If your trip has to be cancelled for coverage reasons such as
illness, accident, death of a family member or traveling companion, jury duty,
weather conditions which cause delay/ cancellation of travel or fire or flood
in your home, this coverage protects your investment and will reimburse the
normally non-refundable payments you make for your vacation rental, airline
tickets and other covered travel related fees.
If
you miss your planned departure for a covered reason, you may also be covered
for additional travel expenses to reach your destination. If you have to
interrupt a trip due to a covered situation such as illness, this insurance
will cover your transportation home.

These policies are
established in order to preserve a fair and orderly site for the advertisement
of resort rental properties AND in order to maintain a "family safe"
environment. Note that these policies are subject to periodic review and
may be updated at any time. Please also see the disclaimer above. There are
specific locations for the inclusion of web addresses (also referred to as
"links" or URL which means Uniform Resource Locators) and rental Broker e-mail
addresses in the AR~MLS® listings. All Web Addresses or Links
must be approved and must reside only the authorized "Links to more
information" section of the ad. Email Addresses and Phone Numbers must
reside only in the authorized locations within the listing. All other
references to specific web addresses, web sites, email addresses or phone
numbers are not considered acceptable content and may be removed WITHOUT
NOTICE. All content must be "family safe" and "G" rated.
Ads may not contain vulgarity, or comments related to violence, hate, or
references of a sexual nature. All such references are not considered
acceptable content and may be removed WITHOUT NOTICE. In the case of disputed
content, the operators of this site will be the final judge as to the
appropriateness of the content.
